Trailer Hire Agreement
This Trailer Hire Agreement ("Agreement") is made and entered into as of ……/……/…….. by and between:
Taylor’s Trailers ("Owner"), a company registered in England and Wales with registered address at

………………………………………. (“Hirer”), an individual with residential address at:

1. Definitions
"Trailer" means the trailer described in Schedule 1 of this Agreement, together with all its accessories and equipment.
"Equipment" includes the Trailer and any accessories provided with it.
"Hire Period" means the period commencing on [Start Date and Time] and ending on [End Date and Time], as specified in Schedule 1 of this Agreement.
"Hire Charges" means the charges payable by the Hirer to the Owner for the hire of the Trailer, as specified in Schedule 1 of this Agreement.
2. Hire of Trailer
a. The Owner agrees to hire the Trailer to the Hirer for the Hire Period and the Hirer agrees to hire the Trailer from the Owner for the Hire Period.
b. The Hirer shall pay the Hire Charges to the Owner in full prior to the commencement of the Hire Period, as specified in Schedule 1 of this Agreement.
3. Condition and Security of Trailer
a. The Hirer acknowledges that the Trailer is in good condition and fit for the purpose for which it is hired.
b. The Hirer shall return the Trailer to the Owner at the end of the Hire Period in the same condition as it was in at the commencement of the Hire Period, fair wear and tear excepted.
c. When not in use, the Trailer must be secured with a British Standard wheel clamp or hitch lock unless it is kept in a fully enclosed and secure building made of brick, stone, or timber with doors locked by a 5-lever lock.
d. The Hirer shall be liable for any damage to the Trailer during the Hire Period, other than fair wear and tear.
e. A number plate displaying the registration number of the tow vehicle must be displayed on the car of the Trailer at all times.
4. Use of Trailer
a. The Hirer shall use the Trailer only for lawful purposes and in a careful and proper manner, for social, domestic, pleasure, or business purposes only, excluding any race, competition, or trial.
b. The Hirer shall not sublet or otherwise part with possession of the Trailer.
c. The Hirer shall not take the Trailer outside the UK without the express written consent of the Owner.
d. The Hirer is responsible for ensuring the Trailer is loaded safely and that the load is adequately secured at all times.
5. Hirer's Obligations
a. The Hirer shall provide the following documents to the Owner prior to the commencement of the Hire Period:
i. Valid UK driving license
ii. Utility bill or bank statement dated within the last 3 months, showing the Hirer's current residential address
b. The Hirer shall ensure that the tow vehicle's insurance covers risks of theft, loss, or damage to the Trailer, or obtain additional insurance as required.
c. The Hirer is strongly recommended to arrange adequate breakdown cover, as no such insurance is provided with this Trailer hire.
d. In the event of any accident (even if the Equipment is not damaged), fire, theft, loss, or damage to the Equipment, or any fault requiring repair, the Hirer shall inform the Owner within 24 hours, excluding public holidays.
e. At the end of the Hire Period, the Hirer shall return the Equipment to the Owner's address from which it was collected, in the same condition as at the start of the Hire Period, fair wear and tear excepted.
6. Insurance
a. The Hirer shall maintain comprehensive insurance for the Trailer during the Hire Period.
b. The Hirer shall be responsible for any excess payable under the insurance policy in the event of a claim. If the Hirer's insurance is insufficient to cover the full cost of any damages or loss, the Hirer shall be liable for the remaining balance.
7. Liability
a. The Hirer agrees to be fully responsible for all claims, liability, damages, losses, costs, and expenses, including legal fees on a full indemnity basis, suffered or incurred by or awarded against the Owner arising directly or indirectly as a result of any breach or default by the Hirer in discharging their obligations under this Agreement.
b. The Hirer agrees that the valuation of the Trailer, together with any associated security devices, is at market value.
c. The Hirer agrees to be liable for the full cost of replacement or repair if the Trailer is damaged, stolen, lost, impounded, or involved in an accident during the Hire Period.
8. Non-Compliance
If the Hirer fails to comply with any of the terms and conditions of this Agreement, they shall be obligated to:
a. Immediately return the Equipment to the Owner.
b. Pay the Owner on demand the full value of any loss suffered as a result of the non-compliance.
9. Termination
a. The Owner may terminate this Agreement forthwith if the Hirer fails to comply with any of the terms of this Agreement.
b. The Hirer may terminate this Agreement at any time by giving the Owner written notice, but shall remain liable for any Hire Charges due up to the date of termination.
11. Late return fees
In the event the Hirer fails to return the Equipment by the specified End Date and Time in Schedule 1, the Hirer shall pay a late fee calculated as follows:
For the first 4 hours past the agreed return time: £10.00 per hour or part thereof.
For delays exceeding 4 hours: A full day's hire charge as specified in Schedule 1, for each 24-hour period or part thereof that the Equipment remains unreturned.
This late fee will continue to accrue until the Equipment is returned to the Owner. The Hire Period shall not be considered terminated until the Equipment is returned and all outstanding fees, including late fees, are paid in full.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
11. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements or understandings, whether oral or written.
